Types of Bankruptcy
Since the bankruptcy code has undergone many new changes and additions in recent years, it can be confusing to know what type of bankruptcy you qualify for and which type will best help you meet your financial goals. I will evaluate your financial situation through “means testing” to determine what type of bankruptcy (Chapter 7 or Chapter 13) you are eligible to file. Below is some brief information to help you understand the key differences between Chapter 7 and Chapter 13:
Chapter 7: “Straight” or “Liquidation” Bankruptcy
Since Chapter 7 bankruptcy is sometimes called “liquidation” bankruptcy, people often worry about losing their property when they file for bankruptcy. In the vast majority of cases, people do not lose any property at all. They have adequate exemptions to protect their house, their car, or their retirement funds. However, since filing for bankruptcy can be complicated, you need to speak with a Los Lunas bankruptcy lawyer. I will guide you through Chapter 7 bankruptcy filing by helping you make key decisions that will help you protect your property and assets. I will also process your Chapter 7 filing for a flat-rate so that you know exactly what you are paying up front!Chapter 13: “Reorganization” Bankruptcy
Chapter 13 requires you to use some of your income to pay your debt. Reorganization bankruptcy requires you to pay certain debts (called “Priority Debts”) in full. These debts include child support, alimony, student loans, tax debts, and those debts that you may have incurred through fraud or malicious acts. Other debts (called “Secured Debts”) do not have to be paid in full—or at all—through a Chapter 13 repayment plan. To be eligible for Chapter 13 reorganization bankruptcy, you must meet specific income requirements. If your income is irregular or too low, you may not qualify to pay your debts through a Chapter 13 repayment plan. In addition, if your debt is too high, you may be ineligible for Chapter 13. I will help you determine whether or not you qualify for a Chapter 13 repayment plan.
Before you can file for either type of bankruptcy, you must complete credit counseling through an agency approved by the United States Trustee's office. I will help you identify an approved credit counseling agency and alert you to all of the other necessary steps you must take to file for bankruptcy in New Mexico.
Out-of-City Bankruptcy Process
I am able to file bankruptcies all over the State of New Mexico. While my law office is located in Albuquerque, I am able to handle bankruptcy cases for clients through telephone communication, fax, and regular mail. At the Law Office of Larry Leshin, we go through the following procedure when handling cases for clients living in Los Lunas:
- We schedule a telephonic appointment to discuss your bankruptcy issues.
- After speaking with you for about 30 minutes, we send you an intake packet that outlines the types of documents you will need to provide in order to get your bankruptcy case moving.
- You collect your tax returns, credit reports, pay stubs, credit counseling certifications, list of creditors, etc., and mail these documents to our office.
- We prepare your paperwork and mail it to you.
- You review the bankruptcy paperwork carefully, sign it, and then mail it back.
After your bankruptcy is filed, you will be assigned to attend a hearing at one of five New Mexico hearing locations (Albuquerque, Santa Fe, Las Cruces, Roswell, and Farmington). Your hearing will be scheduled at the location that is closest to where you live. A representative from the Law Office of Larry Leshin will accompany you to ensure you are properly represented during your hearing.
Contact Me when You Want to be Represented by a Skillful Bankruptcy Attorney
While you may think it is more convenient to hire a bankruptcy lawyer in Los Lunas to handle your bankruptcy case, consider that attorneys outside of Albuquerque—the seat of the New Mexico Bankruptcy Court—usually charge much more than I do. Attorneys in the outlying areas have been known to charge over $2,000 for a simple chapter 7 filing! I provide payment plans and low-cost flat-rates to ensure that New Mexico families and individuals—who are already in great financial distress—can afford my services. Contact the Law Office of Larry Leshin to speak with me—an experienced bankruptcy lawyer who will protect your best interests.
